My Boss Is Constantly Bullying and Micro-Managing Me. Is It Harassment?

There is a difference between bullying/micro-managing and unlawful harassment. Bullying and micro-managing are typically not unlawful harassment if the “boss” treats everyone (or most employees) the same across the board and the behavior is not motivated by a discriminatory reason. In other words, a “boss” can be an A-hole so long as it is not to discriminate against you because you fall within a protected class.

What are these protected classes? Some examples are:

  • Race or National Origin
  • Religion
  • Sex
  • Gender or Gender Identity
  • Sexual Orientation 
  • Disability or Medical Condition
  • Marital Status

Note that there must be evidence to support that the boss’ behavior is due to a discriminatory reason. For example, it is not enough to say the boss is harassing me because I am Latinx. Instead, there must be an example of the link – for example, my boss is constantly telling me he needs to check that I’m working because he knows how us Mexicans love our siestas.
