I Have Been Unfairly Terminated. Can I Sue?

Unfair termination is not the same as unlawful termination. Many people think that because an employer has treated them “unfairly,” they can sue the employer. While it is certainly unfair to lay off or fire a great worker – especially a long-term, loyal employee – it is not illegal. Most employment relationships in California are “at-will employment” relationships, which means the employer can terminate an employee for just about any reason except certain protected reasons.

Some examples of protected reasons that may allow you to sue your employer for unlawful termination are:

  • You spoke up about sexual harassment and were terminated for doing so
  • You took a medical leave of absence and were terminated for doing so
  • You requested reasonable accommodations and were terminated for doing so
  • You were injured while working and were terminated because of the injury
  • You complained about an unsafe condition at work and were terminated for doing so
  • You refused to break the law and were terminated for resisting
  • You raised concerns about not being paid wages or overtime and were terminated for doing so
  • You spoke up about not receive 10-minute breaks and/or 30-minute lunches and were terminated for doing so
  • You spoke up about race or gender discrimination and were terminated for doing so
